Jurisdiction for Trust products


If I select a particular jurisdiction in the interface, does it follow that stamp duty will be assessed in accordance with the laws of that jurisdiction?

Not necessarily. The jurisdiction referred to in the Trust Deed means that if there is a dispute concerning the Trust Deed, then the parties to the deed agree that the laws of that jurisdiction will apply. As a result it is advisable that the jurisdiction, wherever possible, should reflect the location of the key parties and key assets of the Trust.

The jurisdiction chosen does not determine the jurisdiction(s) in which the Trust Deed must be assessed for duty. This will depend primarily on the location of the trustee, beneficiaries and the trust assets.
