The Service Agreement Structure
The Service Agreement allows you to create a contract between:
- a professional service provider (known as, the 'Principal'), which may be a company, corporate trustee, individual or partnership ; and
- a service entity (known as, the 'Service Provider'), which provides services to the Principal.
The Cleardocs Service Agreement contract works only if the Service Provider is a company.
The Cleardocs Service Agreement contract allows the parties to determine the appropriate level of fees the Principal is to pay the Service Provider in return for the services. However, the Service Agreement does not set the actual rates — this is the responsibility of the parties involved.
The Service Agreement contract specifies that fees payable to the Service Provider must not exceed certain indicative rates published by the Australian Taxation Office in its publication 'Your service entity arrangements'. You can view this publication here.
