If the company is to be a charity then you must arrange for a lawyer to:

prepare or review the clauses in the company's constitution (in particular, the clause that sets the company's objectives);

prepare the application to the ACNC for registration as a charity and the ATO for endorsement as an income tax-exempt entity;
- prepare the application to the ATO for endorsement as a Deductible Gift Recipient (DGR); and
-
do any other work involved in the application process, including liaising with the ACNC and ATO, responding to questions and requests.
If you arrange for the legal work to be performed by our legal advisers at Maddocks, then
Maddocks will use the Cleardocs electronic lodgement portal to apply to ASIC to register the company. After the company is registered, Maddocks
will contact you to provide your Certificate of Registration and other company documents.
Maddocks' professional fees for reviewing the constitution are usually around $1,500.00, plus GST. They will provide you with a separate estimate of its fees for ACNC registration and DGR status application.
If you arrange for that work to be performed by another law firm, then that firm will need to lodge
your application to register the company with ASIC direct.
