Reference:1414692 (Change SMSF Trustee (death of a trustee))

The legal information and commentary on this site is general only. Documents ordered through Cleardocs affect the user's legal rights and liabilities. To assess their suitability for the user, legal, accounting and financial advice must be obtained.

Before you start: Change SMSF Trustee (death of a trustee)

The Fund does not require a Cleardocs deed for the order you are doing today. Although it has been designed to be used by an SMSF that has a Cleardocs deed, it may be used for other SMSF deeds provided that deed contains a standard appointment power. You must seek legal advice about the suitability of the document package for the Fund's circumstances to ensure that the deed contains the relevant powers.

A Cleardocs deed?

If the Fund has, or ever had a Cleardocs deed, we can use answers from an earlier order for that Fund to "pre-populate" some answers on the next page. You should check the answers to ensure they reflect the current status of the Fund.

Has the SMSF ever had a Cleardocs deed?

Is the trustee a company?

If the fund has a corporate trustee and the person who has died was a director of the corporate trustee, then you don't need to change the trustee for this reason. Read more about this in our frequently asked legal question. If the trustee is not a company, you can proceed by pressing "Save & Continue".
