Stamp Duty - Trusts NSW

Use Cleardocs to pay stamp duty on your NSW trust deeds that establish any of the following types of trust:

To lodge a trust deed for stamping in New South Wales, it must:

  • be executed in New South Wales;
  • not contain identified or dutiable property; and
  • be signed and dated by all relevant parties.

Under the law, you are required to pay stamp duty on trust deeds established in New South Wales, with the exception of superannuation trust deeds, within 90 days of signing the deed.

What is included in the Cleardocs service?

The Cleardocs service includes:

  • electronic lodgement of your trust with the NSW RO for assessment and payment of stamp duty; and
  • an official NSW RO digital Duties Notice of Assessment will be generated confirming stamping of the trust deed.

What information do I need to arrange for payment of stamp duty through Cleardocs?

If you created the trust deed using Cleardocs, we will already have the required information.

If your trust is not a Cleardocs trust, you will need to provide to us:

  • the type of trust;
  • the name of the trust;
  • the date the trust was executed;
  • the details of the trustee;
  • the details of the settlor/unitholders; and
  • a copy of the trust deed.

Does Cleardocs arrange payment of stamp duty for deeds in other states and territories?

At present, Cleardocs can only arrange for NSW and Victorian deeds to be assessed for stamp duty.

How long does it take for the deed to be stamped?

After we receive your payment, we will electronically lodge your trust with the NSW RO for assessment and payment of stamp duty. The NSW RO's expected turnaround time to issue their certificate is 3 business days.

If the NSW RO has any issues processing the deed for stamping, we will contact you to advise the reason and obtain the further required information.

Late payment of stamp duty

Under the law, you are required to pay stamp duty on trust deeds established in NSW, with the exception of superannuation trust deeds, within 90 days of signing the deed. After 90 days, interest is imposed by the OSR. For deeds over 90 days old, Cleardocs cannot assist you and you should contact the OSR directly to arrange stamping.
